A BALANCED REFORM FOR THE MANAGEMENT OF FOREIGN DETAINEES: ANALYSIS AND PROPOSAL ACCORDING TO THE BALANCING OF HENRI BARBEBLANCHE
INTRODUCTION
Henri Barbeblanche, philosopher and creator of
Equilibrism, after consulting specialists in French law, lawyers and jurists,
proposed an in-depth analysis of the situation of foreign detainees in France.
Taking into account several legal, financial and humanitarian aspects, he puts
forward a solution based on the principles of balancing. This solution is
opposed to the current policy which consists of maintaining foreign detainees,
convicted of crimes or offenses, on French soil.
1. Balancing
Analysis
France, in 2023, had around 72,000 prisoners,
including 19,000 foreigners. The average annual cost for a prisoner in France
is around 45,000 euros. This means that the management of foreign detainees
costs the French state around 855 million euros per year. Some of these
prisoners are serving long sentences, thus increasing the total cost over
several decades.
Henri Barbeblanche observes that not only do these
individuals represent a significant financial burden for French taxpayers, but
that they could also, in certain cases, use the subtleties of French law to
reduce their sentence or delay their expulsion at the end of their detention.
These individuals then benefit from care, food, accommodation, and sometimes
even professional opportunities for years at state expense.
2. A
Balanced and Economic Reform
According
to Barbeblanche analysis, the most pragmatic and balanced solution would be
immediate deportation to their country of origin after the final conviction.
This process would ensure that no additional burden weighs on the French prison
system, while respecting the legal procedure necessary to pronounce the
sentence.
3. Economic
benefits:
• Direct savings: If the 19,000 foreign
prisoners were deported after their conviction, France would save around 855
million euros per year.
• Over several decades: For long-term
sentences (estimated between 20 and 30 years), this could represent a total
saving of up to 25.65 billion euros.
4. Freeing
up places in prisons:
The immediate release of these 19,000 places
would make it possible to relieve congestion in French prisons, which currently
exceed their capacity. This would provide better management of resources and
conditions of detention for remaining detainees.
5. Law
Reform and Humanity
Henri Barbeblanche specifies that this balanced
proposal respects the principles of justice while taking into account economic
and social reality. It is important to respect the human rights of individuals,
but this does not mean that France must bear the cost of their detention
indefinitely. By combining justice, humanity and pragmatism, this solution
would allow France to free up significant resources for other priority needs.
CONCLUSION
In conclusion, this balanced approach does not
advocate a break with humanitarian values, but proposes a reform more adapted
to current economic and legal realities, while reducing the burden that foreign
criminals represent for the French penal system.
